A mother who pleaded guilty to fraudulently enrolling her six-year-old son in the wrong school district has been sentenced to five years in prison.
Tonya McDowell sent her son to an elementary school in Norwalk, Connecticut, instead of her home city of Bridgeport.
The 34-year-old, who was homeless when she was charged with felony larceny last year, said she wanted the best education possible for the boy.
McDowell last week entered her plea at Norwalk Superior Court under the Alford Doctrine, which means she does not admit guilt but concedes the state has enough evidence to convict her.
Authorities told the hearing that she used a babysitter’s address to enroll her son in kindergarten in Norwalk when he should have attended schools in Bridgeport, her last permanent address.
Her case drew national attention and support from civil rights leaders and other advocates who wanted the charge dismissed.
McDowell told police she was living in a van and occasionally slept at a Norwalk shelter or a friend’s Bridgeport apartment when she enrolled her son Norwalk’s Brookside Elementary School.
Police said McDowell stole $15,686 worth of ‘free’ educational services from Norwalk.
She also pleaded guilty to four counts of sale of narcotics, which will be included in her prison sentence.
In a separate case, she pleaded guilty on February 7 to selling drugs.
McDowell’s lawyer, Darnell Crosland, said she agreed to accept a plea bargain rather than continue fighting the charges even though she insists she is not guilty.
Mr Crosland said: ‘You shouldn’t be arrested for stealing a free education. It’s just wrong.’
McDowell was sentenced to 12 years in jail, suspended after she serves five years, and five years probation.

She has no true address, that is the definition of homeless. So I really don't get the charge and definitely don't get the sentence! That is beyond phucked up! Poor kid, too! :(
And let me add ... for the cost of incarcerating her year after year and costs for fostering, etc for the child, the state would probably spend less finding them affordable housing and giving her assistance toward schooling/ job placement, etc!I love purple; I love cats. This is just SICK!! Five years in PRISON for enrolling your child in the wrong district!!! That is the same as if she did a felony crime (on the low end)!! How ridiculous!!

Grrr. Another reason to deeply dislike the justice system. This is so fucking wrong. I hope whoever sentenced her gets to be homeless some day.

That's what you get for trying to be a good Mom and see your child gets a good education? Really!?! Ummm...yeah, the drug things are bad, but I'm going waaay out on a limb here and gonna guess she was probably selling drugs to feed her kid. WTF? Why isn't someone helping these people instead of throwing her in jail and ripping a child away from his mother?

This happened in Ohio when a woman used her fathers address. Destroyed her career (she had one semester left to finish her teaching degree). The Govenor stepped in and changed it from a felony to a misdemeanor. Doesnt our criminal justice system have something better to do??

Am I the only one who reads this differently? It sounds to me she is going to prison for selling drugs . If she didn't have a criminal record to begin with she would not go to prison for enrolling in the wrong school. I have a feeling they put that in the article to sensationalize it. The school part is probably ten days in jail, the rest for selling drugs.

So we lock up people who want a better education for their kids quick as hell, but you can kill a kid and claim he attacked you and u walk free....glad justice has been served.....not!

OMFG are you kidding me?O.K. My mother in law is a school teacher for the Norwalk school system and I also know Bridgeport is a shit hold. I don't blame the mother for wanting her son to go to school in Norwalk. I wouldn't want my kids to go to school in Bridgeport either. Norwalk schools aren't super great, but they're MUCH better than Bridgeport and I don't see why the mother should be going to jail over this?? She didn't "steal" a damn thing. Give me a break. I agree with her serving time for drug charges, but not over the school issue. There are much worse things in this country that people are doing then enrolling their kid in the "wrong" school.What a bunch of dumbasses. I can't wait to ask my MIL about this and if she knew the poor family.

I'm kinda with @loveit on this one. If the majority of her sentence was for enrolling her child in the wrong school district, then no, she definitely shouldn't do that much time (which she probably won't anyway). But I would bet that most of her sentence is related to drug charges. I'm sure she was probably just doing what she thought was the best way to take care of her child, but the drug game is dangerous, so probably not the best idea. I understand why she'd want to send her child to a better school, and really there should have been no charges that stemmed from that if she had no permanent address. Especially for a public school that residents of the district can attend for free.

I dont know much about this case but the woman in Ohio had a squeaky clean record and was in college - to be a teacher I believe. I believe thats why the governor stepped in. It's hard as hell to get a teaching job with a felony. But it infuriates me nonetheless. How do you "steal" a public education ??

ok this is one of the most screwed up things I have ever seen in our justice system!!! So a mother is being punished for wanting a better education for her child, yet repeat sex offenders get less time???? and people want us to believe in our justice system, give me a damn break!!!!
