    Pennsylvania Bill Would Reduce Welfare Benefits For Women Who Cannot Prove They Were Raped

    Pennsylvania House bill seeks to limit the amount of TANF assistance that low-income women receive based on the amount of children they give birth to while covered under the program.

    Despite the fact that low-income women who give birth to children would logically need increased assistance to care for their larger family, Pennsylvania lawmakers — State Reps. RoseMarie Swanger (R), Tom Caltagirone (D), Mark Gillen (R), Keith Gillespie (R), Adam Harris (R), and Mike Tobash (R) — don’t want their state’s welfare program to provide additional benefits for that newborn. If a woman gives birth to a child who was conceived from rape, she may seek an exception to this rule so that her welfare benefits aren’t slashed, but only if she can provide proof that she reported her sexual assault and her abuser’s identity to the police:
    In determining the amount of assistance payments to a recipient family of benefits under the Temporary Assistance to Needy Families (TANF) Program, the department shall revise the schedule of benefits to be paid to the recipient family by eliminating the increment in benefits under the program for which that family would
    otherwise be eligible as a result of the birth of a child conceived during the period in which the family is eligible for benefits under the TANF Program
    . [...]

    Elimination of benefits under subsection (d) shall not apply to any child conceived as a result of rape or incest if the department: (1) receives a non-notarized, signed statement from the pregnant woman stating that she was a victim of rape or incest, as the case may be, and that she reported the crime, including the identity of the offender, if known, to a law enforcement agency having the requisite jurisdiction or, in the case of incest where a pregnant minor is the victim, to the county child protective service agency and stating the name of the law enforcement agency or child protective service agency to which the report was made and the date such report was made.


    The language of the bill goes on to note that a sexual assault victim applying for an exemption will be required to sign a statement affirming she understands that “false reports to law enforcement authorities are punishable by law,” and stipulates that Pennsylvania will report any “evidence of false statements or fraud” to the correct department, all the way up to the Attorney General’s office.

    Aside from punishing women who have children — particularly low-income women who may not have reliable access to affordable contraception
    — the proposed bill perpetrates a dangerous attitude toward survivors of sexual assault. Forcing women to prove the legitimacy of their sexual assault, and warning them about the serious consequences of “crying rape” to cheat the system, puts forth the misguided assumption that victims of sexual violence are not to be believed. Furthermore, countless women choose not to report their rapists to the police because they fear repercussions from their abusers, who could threaten their lives. An estimated 54 percent of sexual assaults are not reported to the authorities.

    This is not the first type of legislation of its kind. Last month, New Mexico proposed a bill that would have required women seeking childcare assistance to prove they were “forcibly raped,” although Gov. Susana Martinez (R) has requested to remove that language.

    Take away birth control or make it too expensive.
    Make the day after pill and abortion illegal.
    Don't give aid to women who get pregnant and the man bails.
    Then elect a president who lied during a trial so his friend's wife would get less money (saying company was worthless while they cashed in tons from stock), take away the child then have said friend sit as head of healthcare for the state while canceling the health insurance of ex-wife, who has MS and cancer. (Staples) Not to mention his binders full of women.

    If this all comes into play, I won't be going back to the usa in a very long time.

    I guess nobody thought of the fact that false accusations of rape may go up as well, clogging the police department and E.R.s. It would probably be easy for a desperate woman who is panicking to state she was raped at a party or something and "not remember." I don't like to think that way about my own sex, but I personally know at least 2 people who would probably do this, bet there are others.

    I'm NOT agreeing with this, not even a little bit. Its disgusting, but I need to point out an inconsistancy here. PA has a special health care program for women that offers free contraceptives to low income women. The offering isn't limited either. I got a copper iud with it.

    I'm not attacking PA but the whole fucking system - one thing will lead to another as our rights get stripped away, a little in this state, a little in that and soon enough there will be states with no women's health. Did anyone notice how the girl who asked the simple equal pay question in the debate (that led to the binders comment) has since been treated? As a SLUT! There is a serious problem in the USA.

    It's a slippery slope. We HAVE to make sure that we vote someone into presidency that realizes what a big step back this would be. The whole reason Roe v. Wade was ever brought before the supreme court was because of the overwhelming risk and inherent danger that comes with performing illegal abortions. History has shown time and again that it happens. Just like with the war on drugs--make something illegal and people will do it anyway, they just have to try to do it without getting caught. When complex procedures become illegal, they also become very dangerous.

    The ban on contraception is just as ridiculous. People are surrounded by sex. It saturates our media. So just say no to it...abstinence is the only way. Um, yeah...how well was that working 50 years ago? Not so well. These people are scary. They are a threat to the freedoms we know and love in this country. This kind of legislation shouldn't even be a blip on the radar, much less become an actual bill to be brought before a vote. Vote Democrat, Libertarian, Independent, Green, just don't vote Republican if you value your right to decide for yourself.

    @beam, they did come from planned parenthood, but they did not have to. I choose to use their services because I support their role in the community. The women's healthcare program that I was eligible for came from the state.

    I disagree with the rape part of this, but I understand what PA is trying to do by cutting TANF to people who have kids while ON it. I know too many people who have more kids while on aid BECAUSE they get more money. They also happen to be the same people who don't use it for the things it should be used for. So I agree with that part of it, but not with the rape part.

    Yes, I know BC fails. Thats how my son was conceived. However, I thoroughly believe that having less coming in from the government because you had a kid you couldn't afford might actually motivate people to get OFF the aid instead of coasting along with it because they have it and it puts them in a good place so why try?

    I'm not trying to bash anyone, but I have lived in a lot of places with ridiculous populations of people on federal aid who used it like this. I wholeheartedly agree something needs to be done to stop the people who purposely do this, and this thing would do that.

Five states had no time limit, and 17 states had time limits shorter than five years.     This is kind of (okay- completely) off track, but I read an article a while back (like 5 years ago) where the reason why abortion and the women's reproductive rights are coming more to light was because abortion and contraceptives were working "too well" - meaning women have lowered the amount of the tax base by not getting pregnant or terminating the pregnancies so there are less children growing up to become workers giving money (taxes) to our government.....less money for social security.....less members of the military......so on and so on..... the government is basically a giant pyramid in how money is generated.  If you start thinking about it this way- why our politicians are declaring war on women starts to make a lot more sense.

But what I can't get over is that the same people who are so anti-contraception and abortion are the ones who are also all for basically shutting down public assistance. I think that's positively ridiculous. The very women who would end up having child after child without full reproductive rights are the ones who would need welfare if they had more children than they could afford. Women's reproductive rights are tied directly to the economy. All I know is that I have been in the position where I had to choose between work and being a SAHM. When the SAHM won, it was simply because it didn't pay for me to take the job. Gas and childcare alone would have eaten my entire paycheck. So here's a suggestion...how about we give women more competitive salaries and then raise the minimum wage across the board. Better incomes mean more stable families. Stable families will be more inclined to grow the population, and then the greedy fucks on Capitol Hill can have their workforce and tax base expand. Then everyone gets what they want and no one ends up double fucked because they wanted to have sex with their husband.

  • Ok, I think this legislation is really retarded. On another (quasi related) note, I do see women who keep having kids, knowing that they can't even afford to provide for the ones they have. And this goes beyond the welfare program. In general, if you are struggling to provide for your children as it is, whyyyyyyyy would you keep bringing other children into that situation?
